The most important aspect of sentencing in DWI convictions in NC is the weighing of aggravating, and mitigating factors. You'll want your DWI lawyer to go over the facts of your case so that you can have a clearer picture of where your sentencing may fall. Factors that mitigate must be shown by a preponderance of the evidence by the DWI-DUI defense. Aggravating factors must be proven by the state beyond a reasonable doubt.  For sentencing guidelines based on DWI level, visit my page on DWI SENTENCING GUIDLINES.
