Experienced Asheville Traffic LAWYER for Driving While License Revoked, Reckless Driving, speeding Tickets, Or any Automotive related offense.
Many attorneys focus a portion of their practice on defending, and resolving criminal/ infraction citations that are issued on our public vehicular areas. Most of my clients don't realize that many NC tickets are criminal charges, while some of the tickets are infractions that can be paid online. Despite the convenience, NEVER pay infractions online without consulting us first! I focus a large portion of my practice on these type violations. I attend administrative (Admin) court in Asheville every single time it is conducted, and I know how to get the best resolution to any ticket you may have received. Keep in mind, simple reductions may seem simple, but if the wrong option is chosen, you may have wasted your day in court and your license! Don't expect just any lawyer to figure out what is the best option, nor should you rely on court employees as they cannot, and will not give you advice. You need an effective and skilled speeding ticket attorney to help you!

Some Common Traffic violations that I handle:
DWLR - Driving with a Revoked License
Driving while License Revoked (DWLR) is a serious misdemeanor offense that calls for the assistance of an effective advocate. Licenses can be in a revoked state for a number of reasons and when you're caught driving revoked, this is what you'll be charged with. Again, these stops must be analyzed for constitutionality to see if an effective defense exists. If a successful defense to the stop can be asserted, your charge could be completely dismissed on those grounds. However, usually these type charges can be handled much more easily with the path of least resistance. Either way, there is no substitute for the assistance of an effective driver's license attorney in negotiating your situation, and navigating the separate DMV process for potential restoration of driving privileges.
Why Should I spend the money to hire aN attorney for a Traffic ticket like this? I just forgot to handle an issue with my license...
Often times your license may be revoked for failure to pay a speeding ticket or failure to appear on a traffic citation, etc. These situations can often be fixed so that your ticket can be rescheduled for hearing and disposed of properly, which means you can then get your license back.
If you are able to fix the ticket problems that led to the DWLR and get your license reinstated, the DWLR *could possibly be dismissed (*maybe not always the case, depends on the situation.)
Many potential clients choose to go face the DWLR and backlogged license issues alone. I highly advise against this. The expense of hiring a skilled traffic violation lawyer is easily worth the cost.
If you pay the fines and costs for the DWLR you will be stuck fixing all your previous ticket issues (which also carry costs) and you will be convicted of a misdemeanor crime and face a revoked license for an additional year. Not to mention your insurance (If you ever get your license unblocked again) will skyrocket by multiples.
The money you will spend to hire an effective defense lawyer will likely be far outweighed by the Improved outcome and savings in headaches!
Reckless Driving
Reckless driving is a common charge and is broadly defined by statute. So broad it is almost vague in my opinion. Nevertheless, Reckless driving is a serious misdemeanor charge that carries enough license and insurance points to roughly DOUBLE your insurance. Also, if you plead guilty to reckless driving you will be creating a criminal record. Reckless driving can often accompany severe speeding tickets and complicate those matters worse. You will Definitely want an effective traffic defense lawyer to represent you when facing these charges.
Hit and Run
Hit and run (leaving the scene of an accident you caused) is a serious charge that you don't want to face alone. Hit and Run with personal injury involved can be a felony. Often times Hit and Run charges can be dismissed depending on the circumstances, and provided any damage is paid for. Usually this can all be handled without you needing to appear in court. Call an attorney in Asheville who is ready for traffic court, and ready to discuss your options if you've been charged with hit and run.
Unsafe Movement
Usually unsafe movement tickets will be issued when an accident has taken place. These tickets can usually be handled with appropriate proof of insurance pay outs showing the injured party was made whole. But the insurance documents must be written in a particular way, or the district attorney will deny them. Often times, if fault was mutual in an accident, a Prayer For Judgement (PJC) is the best solution to Unsafe Movement. These charges come in many different types such as, failure to reduce speed, failure to yield, etc. Call to find out how I can help you avoid going to court and resolve your ticket in the most efficient manner.
Pre-Arranged Racing And speed Competition
These type charges are serious misdemeanors, with statutory requirements upon conviction that can ruin your life. Racing charges will revoke your license for up to 3 years, and can cause you not just to lose your license, but loose the car involved as well! Call a defense attorney for these type charges immediately!
Texting While Driving
This charge is often difficult for the state to prove without an outright admission. Using hands free options, tuning music, or dialing a number isn't necessarily illegal. The tricky part is, that in order to dismiss this charge, a trial is usually necessary. The cost of trying the ticket could outweigh just paying it. Texting While Driving is a fine only, and has no DMV impact. However, the fine is steep. There are options with these tickets to lower the cost, and possibly even beat the charges altogether.
